In the following terms and conditions “we”, “our” and “us” means Fincaloe (Nele Callebaut), BE1013290902, with all its rights. Fincaloe can be reached via e-mail: hello[a]fincaloe.eu or phone +32 456 64 81 92.

When you buy a product, experience, course, lecture, or ticket to any of our events, or if you host or attend a retreat, team building, or other event at our venue, you agree to these terms and conditions, whether you read them or not.

 

EVENT

A visitor is only entitled to entry to our events, if you can show a purchased valid ticket, or an invitation. On request you should be able to show a valid ID card. If there is an age limit, it will be announced before the event. We do not accept fake tickets, fake invitations or fake IDs. On suspicion of crime, the police will be summoned.

Access to our events could be denied, if you without our permission try to enter with: professional photographic-, film- or sound-recording equipment, food, drinks, animals, drugs, fireworks, weapons, sticks, aerosol dispensers, glassware, CS gas, or other objects that we can consider as dangerous. Our staff has the last word in case of discussion. Confiscated goods are returned for a fee of €100.

Fincaloe is entitled to search visitors to the event, when entering and/or during the event. A person who refuses to undergo such a search may be prohibited from entering the event, or may be immediately removed from the event, without being entitled to a refund of the admission fee. We decide what is necessary to do, in order to maintain public order and safety during the event.

We reserve the right to decide if you are suitable for other visitors. This provision applies even if we are of the view that a visitor wearing an item of clothing, or wearing or carrying any sign, that Fincaloe believes may be discriminatory or offensive to other visitors, that may lead to aggression, agitation or harm Fincaloe or the event. At the entrance should you as a visitor be decently dressed. You must be respectful to other visitors, and you may not strip you naked.

A visitor should not in any way perform, or ask someone to cause damage to third parties, any equipment or anything that is owned or leased by Fincaloe. Any vandalism will be reported to the police, you can also get banned from our future events.

If it's not allowed to smoke indoors, follow our instructions to the designated smoking areas.

The visitors to our events are obliged to comply with the regulations and/or any amendments to them and with instructions given by Fincaloe, the operators of the location where the event is being held, the security staff, the fire brigade, the police and other authorized persons. Visitors who violate an order or prohibition will be removed immediately.

When you purchase a ticket to our event, you are permitted to resell it to a third party. However, please note that the ticket may lose some or all of its value if the name on it does not match the attendee, as this could affect entry requirements. You have no permission to use the ticket(s) as prizes in various competitions, without permission from us. If this prohibition is violated, we will be entitled to refuse entrance to the event. Fincaloe will not, under any circumstances refund a bought ticket.

Visitors enter our events on their own risk. We are always limited to the amount the insurance company pays out, in case of injury. We disclaim all responsibility when it comes to visual disturbance and hearing loss. A visitor should not touch, stand right next to, or look straight into any sound, or light effect. This also applies to strobe effects, laser effects and film projectors. Music may be played loud at our events and Fincaloe advises the visitors to give their hearing a rest periodically during the event, by moving to a space where no, or lower volume of music is being played.

Fincaloe is not responsible for any loss, theft or damage to personal belongings during the event. Guests are advised to keep valuables secure and ensure they have appropriate insurance coverage if needed.

Fincaloe is authorized to make audio and/or visual recordings of any event we make, and the visitors to the events and to duplicate and publish those recordings in any manner whatsoever. When you visit our events, you agree that recordings can be made, edited, published and used, but you can not demand compensation. If a visitor take a photo(s) with a camera or cell phone, Fincaloe owns the photo(s), and have the right to use it for what we want, even if the visitor publishes it/them on the internet, etc.

The marketing we do, such as posters, TV commercials, radio advertising, internet advertising, or other commercial advertising, may not be copied, modified or manipulated without a written permission from Fincaloe.

We will keep our event schedules as best we can, there may be variations and deviations in a planned event. Delay may occur.

Illness or cancellation by Fincaloe, or bad weather conditions, will give Fincaloe the right to postpone any event to another date, or to hold it at another location, or to cancel the event. If an event is moved to another date or being canceled, we will inform you in a appropriate way.

Fincaloe assumes no liability for any damage against the visitors if an event is canceled, such as booked hotels, flights, busses, taxi etc.

We reserve the right to modify or substitute any scheduled activity with another at our discretion. Participants will be informed of any changes as they arise, including during the event itself. Any replacement activity will be aimed at providing a similar or enhanced experience.

As a visitor, you are obligated to stay informed about the events you have tickets for by following us through our website, phone, email, social media, or the event page.

 

WORKSHOPS

Booking a workshop is done by "Make a reservation" on our website or by sending an e-mail.

All workshops are held in either English or Dutch, the choice is yours.

Cancellations made later than four weeks before the event will be charged at 100% of the price. All cancellations must be made in writing, via e-mail, to be approved by Fincaloe.

Fincaloe disclaims all responsibility to inform about ingredients we use during our workshops. It's the customer's own responsibility to inform us if he/she is allergic to anything. Edible and drinkable at our workshops may include, but are not limited to: Aloe vera barbadensis, Arborescens, Avocado, Black pepper, Bread - Gluten free, Cumin, Gin, Ginger, Honey, Jalapeño Pepper, Lemon, Lime, Olive oil, Oranges, Red onion and Soy sauce.

Fincaloe guarantees good quality of our own products and utensils on site. We disclaim all responsibility regarding products, plants and foodstuffs that we have not grown ourselves.

It's the customer's responsibility to keep the place clean, where the workshop is going to be. The place should be in such a good condition that Fincaloe and all participants feel comfortable performing the activity.

The customer understands these terms and conditions and accepts the inherent risks of a workshop environment when they confirm a booking.

 

PAYMENTS

All prices for companies booking workshops, ordering products, or event tickets are exclusive of VAT. For individuals, all prices are inclusive of VAT. We reserve the right to change prices at any time without prior notice.

 

DELIVERY & RETURN

Estimated product delivery time is provided in our product portfolio.

Please note that when shipping products to outside EU, cross border shipments may be subject to opening and inspection by customs authorities. In respect of all products dispatched to you to an address outside EU, you are deemed to be the importer of the products and must therefore comply with all the laws and regulations of the country into which the goods are being delivered.

Let us know when your order if you wish to pick it up at our plantation Spain.

If you receive a damaged product, we require images of the damage to be sent to us for quality assurance purposes. After our review, replacement options, if any, will be provided.

When purchasing products from us via email or phone, you have a 14 day withdrawal period in accordance with applicable consumer protection legislation. However, the right of withdrawal does not apply to the following kind of products:

(a) Products made to the customer's specification or which otherwise has been given a clear personalized character
(b) Products with broken seals, due to health protection or hygiene reasons.
(c) Food
(d) Plants
(e) Date specific products like event tickets and workshop tickets
(f) Bundled products (unless you're returning everything in the bundle)
(g) Gift cards
(h) Downloadable products
(i) Price reduced products

If the product is scratched or used then this is classed as a used product, so we cannot offer you a full refund. The customer is responsible for the product during the return shipping. The return shipping cost is covered by the customer.

 

OUR PRODUCTS

We have a premium quality guarantee on all products produced by Fincaloe. In the unlikely event that a product from us is in such a bad condition that it's not usable, please contact us immediately for a refund.

In the event of a complaint about a product not produced by Fincaloe, the customer accepts that it may take up to 30 days before the issue is solved.

If a product has a limited shelf life, it will be noted in the product description or communicated to you in person when purchasing at markets or directly from us.

 

AMEDMENTS

Fincaloe reserves the right to change the prices and services offered, the policies and these terms and conditions at any time. These terms and conditions may be updated periodically. It's the customer's responsibility to always refer to the latest version published on the site.

For anything not expressly provided for in this contract, the provisions of Belgian law shall apply.
